Agency Disclosure-Designated Agency

The Real Estate agent who has listed a property is the agent of the Seller and is working for the Seller. A Listing Agent has fiduciary responsibilities to the Seller which include reasonable care, undivided loyalty, confidentiality, promotion of clients best interests within the limits of the law and full disclosure. A Seller may authorize Broker’s Agents, associates of other real estate firms, to represent them in marketing their property to Buyers. Although the Listing Agent and Broker’s Agents represent the Seller, they must act honestly and fairly in dealing with a Buyer and must disclose all defects of a material nature affecting the property which are known by the Broker/Salesperson.  A Listing Agent may not represent a Seller and a Buyer in the same transaction.  However, a Buyer can be an unrepresented customer of the listing agent.  With Designated Agency, other agents in our firm may represent clients in the transaction through an Exclusive Service Agreement.  A Seller may authorize their Listing Broker to cooperate with and compensate Broker’s Agent, Buyer’s Agent or both.
